The User Conditions are deemed to be in effect and agreed to whenever users avail themselves of our services, regardless of whether or not they are registered users.

Registered users may, at any time, close their accounts, on their own, for any reason, and cease using BeaucoupPlus services.

BeaucoupPlus also reserves the right to suspend service usage or close accounts without notice, at any time, in the event of fraudulent usage of the site or non-compliance with our rules.

Moreover, the parties assent, finally and conclusively, without condition, to the judicial jurisdiction of courts qualified to hear appeals from the court of first instance.

You acknowledge that the use you make of our Web sites and services (including classified ad service, shopping baskets, blogs or chat rooms) is deemed to have taken place entirely and exclusively within the territory of the Province of Québec (Canada).

In the event any of these conditions is declared null, invalid, illegal or unenforceable as a result of a legal decision, all additional User Conditions remain in force if the general organization of the agreement is not entirely overturned. The titles or paragraph headings are provided solely for reference purposes and do not define, limit, interpret or describe, in any way, the paragraph content.

In the event of any difference or ambiguity regarding this agreement or between the French and English versions of the User Conditions, the contract is to be interpreted in the consumer’s favour.

Minors or those 18 years and under are not authorized to use the site and our services are not offered to them.

Parents are also urged to closely supervise use of the Internet by their children and teenagers in order to avoid situations where they use the BeaucoupPlus Web sites of their parents or open accounts by claiming to be of age. We also urge parents to explain the inherent risks and perils of Internet use to their children, in order to avoid them becoming victims of harassment, fraud or offensive or criminal acts. Use of blocking or parental control software may also be advisable in certain cases, at the parent’s discretion.

Our services are not available to users whose account has been suspended as a result of illegal or fraudulent usage, or in contravention of BeaucoupPlus User Conditions.

Those who do not qualify are prohibited from using our Web sites.

You are fully responsible for transactions or other activities conducted via your account or through the use of your password. BeaucoupPlus cannot be held responsible for unauthorized usage or for any loss or damages resulting from negligence or failure to comply with the security regulations set out in the User Conditions.

We recommend using a password at least 8 characters long (an unusual word and numbers) and to change it periodically for increased security. Should you forget your password, the system can email a reminder to you. Should that occur, you are responsible for changing it.

Please note that BeaucoupPlus will never ask you, via telephone or email or any other means, to reveal your password or any other personal information. Should you receive a request of this kind, do not respond to it and advise our Privacy Officer.

If you share your computer with someone else or access the Net in a public place, remember to close your session and the browser window before leaving the computer to avoid identity theft.

You are also responsible for not ceding or transferring your account to a third party and of advising our Privacy Officer via email as soon as you become aware of the fraudulent use of your identity, account or password.

During registration, BeaucoupPlus collects only the minimum amount of personal information needed for the proper functioning and security of the Web site.

No personal information is collected without the knowledge of the users, and they themselves enter whatever information they wish to reveal. Users are also asked to update their personal information whenever they use the site.

Users are solely responsible for the accuracy of the information they provide, the content they distribute and the consequences of the information disseminated via the Web sites, blogs, chat rooms, classified ads or other BeaucoupPlus services

For additional information, users are urged to become familiar with the BeaucoupPlus Policy Regarding Confidentiality and the Protection of Personal Information included with this document and an integral part of it.

A classified ad service is also available to users who wish to publish their own ads or simply consult those placed by others. That being the case, our role is limited to posting the ads of registered users. We do not intervene in transactions between buyers and sellers, nor do we evaluate the goods and services offered by advertisers. As such, we have no control over the truth or accuracy of the ads placed by users, nor the quality, security or legality of the products or services offered by the former, nor do we guarantee them in any way. BeaucoupPlus does not guarantee the ability of the buyer or seller to respect their commitments or to conclude transactions.

BeaucoupPlus and its registered users are fully independent entities, each party acting in their own names, on their own behalf. Neither the fact that they are registered users, nor the User Conditions themselves, create any links of partnership, common business relations, subordination, employee/employer relations or franchiser/franchisee between BeaucoupPlus and registered users.

THE OPINIONS EXPRESSED BY THE USERS OF OUR BLOGS, CHAT ROOMS OR OTHERS DO NOT NECESSARILY REPRESENT THOSE OF BEAUCOUPPLUS AND ITS SUBSIDIARIES. BEAUCOUPPLUS DOES NOT ENDORSE ANY OPINION OR COMMENT EXPRESSED BY THIRD PARTIES ON ITS SITES, AND ASSUMES NO RESPONSIBILITY IN THIS REGARD.

A detailed invoice will be available online and a link to this invoice will be emailed to you following each transaction, confirming the price of each item ordered and applicable taxes and delivery charges. The amount is payable, in full, in a single payment, at the time of your order.

The user is solely responsible for bank card payments for the products and services purchased. BeaucoupPlus cannot be held responsible for problems related to payment or charges resulting from inadequate functioning of the payment gateway or service used by the financial institution.

IMPORTANT: PROVIDED BEAUCOUPPLUS FULFILS ITS COMMITMENTS, ALL SALES ARE FINAL AND NOT ELIGIBLE FOR REIMBURSEMENT, ONCE THE TRANSACTION HAS BEEN PROCESSED ON ITS WEB SITES.

When you use PayPal or WorldPay gateway, you transmit your credit card or bank information directly to the financial institution. As such, BeaucoupPlus never has access to this information.

We use SSL (Secure Socket Layer) technology to transmit your personal information and safeguard your online credit card transactions. Any information exchanges made through us are encrypted in 128 bits, and safeguarded in order to authenticate our servers and ensure the integrity and confidentiality of the exchanged information.

For enhanced protection, look for a padlock icon at the bottom of the screen and make sure the URL address begins with https (make sure there is an s at the end) before sending any confidential information.

All the previously described measures are designed to enable you to conduct your transactions with complete security and peace of mind.

As a result, BeaucoupPlus, its owners, administrators or employees cannot be held responsible for defaulting on one or more of its contractual obligations, any invasion of privacy, damages or loss of income that result from events beyond its control or a force majeure. This includes any instances already recognized by jurisprudence and, among others, any natural disasters, acts of war, riots, breach of public peace, fires, floods, earthquakes or other disasters, including strikes, lock-outs, in addition to electrical or technical problems, not attributable to the parties, that prevent communications or access to the site.

• Failure to respect existing laws or regulations (including, but not limited to, those governing consumer protection, unfair competition, export laws, discrimination or false advertising)

• Use of our blogs, chat rooms or classified ad service to send to (or from) our sites any
  illegal, threatening, slanderous, malicious, pornographic or obscene information in contravention of Canadian or international laws.
• Deliberately attempt to overload or disturb the functioning of our systems and servers, spread viruses, engage in pirating or compromise, in any way whatsoever, the security or integrity of our resources, computer data, client files or content provided by other users.
• Collect personal information about/email the addresses of other users with a view to sending out advertising, surveys, contest offers or SPAM.
• Use several identities or provide a false identity/information with a view to deceiving BeaucoupPlus or other users, or attempt to bypass the system to access the site or products and services offered there without authorization, or after being banished from it.
• Submit false advertising in order to play malicious jokes or harm third parties.
• Publish duplicate versions of the same ad.
• Copy, modify or illegally distribute any content belonging to third parties without obtaining written authorization from the parties concerned.
• Use the system with a view to contravening our rights or those of other users or result in proceedings against us.
  

You may not use or reproduce any information based on these content elements except for personal, non-business, non-commercial purposes. BeaucoupPlus is not responsible for any damage, injuries or harm sustained, or any loss, fees or additional expenses incurred following the use, consultation, downloading or reproduction of any material displayed or offered on its Web sites, classified ad services, blogs, forums or other chat rooms.

AT NO TIME SHALL BEAUCOUPPLUS, ITS OWNERS, ADMINISTRATORS, AFFILIATED COMPANIES, AGENTS, REPRESENTATIVES OR EMPLOYEES BE HELD RESPONSIBLE FOR ANY CURRENT OR FUTURE DAMAGES, DIRECT, INDIRECT OR COMPENSATORY (INCLUDING INJURY TO REPUTATION, LOSS OF GOODWILL, REVENUES, PROFITS, DATA, USAGE OR ADDITIONAL FINANCIAL OR COMMERCIAL LOSSES) RESULTING FROM:

These User Conditions are in no way aimed at limiting our responsibility or absolving us of it if applicable laws prohibit said limits or waivers. In addition, as a consumer, the rights granted to you under law are not affected.

In the event that our responsibility to a user or third party is incurred, it will be limited to the amounts stipulated below:

We cannot guarantee these links and are in no way associated with them. When you access sites belonging to third parties, you assume full responsibility and do so at your own risk. BeaucoupPlus reserves the right to delete these links at any time, without notice.

WITHIN LIMITS GRANTED UNDER THE LAW, BEAUCOUPPLUS DOES NOT PROVIDE USERS OR THIRD PARTIES ANY GUARANTEES, CONDITIONS OR REPRESENTATION, EITHER EXPRESS OR IMPLICIT FOR:

You agree to save harmless BeaucoupPlus, its owners, administrators, affiliated companies, agents or employees, from and against all damages, direct or indirect, charges, expenses and reasonable legal fees in the event legal proceedings are taken against us by third parties following an infringement, by you or any other person using your account, of our User Conditions or any law or right of concerned third parties.

You agree, however, to waive any intellectual property rights, worldwide, on any ideas or suggestions before submitting them to us, acknowledge that they are not confidential and were in no way solicited by us. You also assign to BeaucoupPlus a non-exclusive, perpetual, irrevocable right that may be subject to a sub-licence authorizing us to use, divulge, modify, translate, reproduce or market as it sees fit, any content provided, with no restrictions, royalties or additional contractual obligations on its part.

The user acknowledges that the information he or she provides BeaucoupPlus in the classified ad section is neither confidential nor exclusive, does not contravene the rights of any individual or entity and may be published or displayed without restriction on the sites of BeaucoupPlus or other affiliated sites.

The ads submitted are, depending on the category and content, manually or automatically approved by BeaucoupPlus prior to being displayed on the site.

Each approved ad is placed in listhead in the category and sub-category consistent with the ad content. Each ad subsequently approved in a similar sub-category is also placed in listhead. Previous ads are then shifted to the bottom of the list.

Payable options are available for moving old ads to the top of the list, on a daily, weekly or random basis or featuring them, on a random or rotating basis, on the site’s home page. We cannot guarantee how long an ad will remain at the top of a list since other users may submit ads subsequently, or opt for the automatic repositioning option as well.

BeaucoupPlus cannot be held responsible in the event two or more competing ads are situated in close proximity to each other.

The length of time the ads are displayed online varies according to rates, current promotions or options selected by the users. BeaucoupPlus reserves the right to revise rates, promotions or the display duration of new ads as it sees fit and without notice.

BeaucoupPlus does, however, agree to respect the display duration of ads already online, as agreed when they were put online OR as it sees fit, to reimburse the amount paid by the user, pro rated according to the number of display days left.

Throughout the duration of the online display, the user may, at no charge, revise the text, title or content of their own ads as they see fit, while respecting the spirit of the message. Users may not, however, change the category or sub-category of their ads. Revised ads are re-submitted for BeaucoupPlus approval prior to being re-displayed online, without extending the total display duration agreed to originally.

Payable options are also available to users at any time for promoting their ads. That being the case, the display duration will be extended, free of charge, for the total number of days agreed to originally.

ONCE SUBMITTED, THE ADS MAY NOT BE COMPLETELY DELETED BEFORE EXPIRY, OR BENEFIT FROM ANY REIMBURSEMENT. The users may however, mask their ads, on their own initiative and free of charge, as they become unnecessary.

As the expiry dates approaches, at the discretion of BeaucoupPlus, an expiry notice may be sent automatically to users to inform them.

Expired ads will be deleted automatically from the site within a few days following the expiry date. Since we do not store expired ads, we cannot recuperate and re-display them. We therefore strongly recommend keeping a copy in your personal files, if need be.

You agree to comply with existing Canadian laws and avoid submitting or publishing ads whose content (text, images, sound extracts or others) contravenes said laws or those in effect in your place of residence.

The following content is prohibited on BeaucoupPlus Web sites

• Any ad containing content of an illegal, immoral, obscene, pornographic or paedophilic nature; those that are in poor taste, offensive, threatening, violent, slanderous, disparaging, hateful, racist or that may contain any other form of discrimination.
• Any ad that may incite violence, hatred, fraud, arms trafficking, alcohol, illegal drugs, or incite people to commit any other illegal activities, in any form whatsoever.
• Ad of a fraudulent, false, deceitful or inaccurate nature or ads that deliberately omit important facts.
• Any ads whose content or publication contravenes intellectual property rights (including copyright, patents or industrial secrets) court orders (including non-publication notices) or the privacy, confidentiality or property of third parties.
• Any ad offering stolen or counterfeit merchandise, drugs or other illegal substances or products/articles governed by controlled possession/distribution laws such as prescription medications, alcohol, tobacco products, police uniforms, military arms or ammunition that are subject to restricted authorization or prohibited on Canadian soil, etc...
• Any ad offering shares (stock certificates, bonds or others) identity papers, permits, demerit points or articles (baby carriages) whose sale is restricted or prohibited under existing laws or regulations.
• Any ad offering health/welfare products claiming magical or miraculous cures.
• Toute annonce proposant la participation à un système de ventes pyramidales ou tout autre système de vente interdit au Canada.
• Any ad suggesting participation in a pyramid sales scheme, or any other sales schemes prohibited in Canada.

• Any ad promoting a site that is in direct competition with the BeaucoupPlus classified ad service, an auction site, or one selling products or services in competition with those sold by BeaucoupPlus.
• Any ad containing corrupted data, viruses, worms or any other computer software aimed at damaging or compromising the operation, integrity or security of our computer system, servers or data bases or that would test its vulnerability, or make it possible to secretly intercept the personal data or information of BeaucoupPlus, its clients or other users.
• Any ad making improper use of key words or those whose title, images or advertised trademarks are not consistent with the description of the ad or the sub-category selected.
• Any ad incurring our responsibility or using unfair competition practices against BeaucoupPlus or any third party.

You may use your company logo on your ad, provided you are legally entitled to do so, are in compliance with laws and regulations governing trademarks and do not damage the company concerned.

You are not permitted to include links in the ad title or description, unless you have paid applicable charges.

In order to prevent spamming, the display of email addresses is also prohibited. Other users may communicate with you via our messaging service, integrated at the bottom of each ad.

In addition, our hosting service provider formally prohibits us from agreeing to publish material, images or videos intended for adults. As such, we cannot offer the following categories: Adult Entertainment, Erotic Massage Service, Escort Services or other adult services. We therefore suggest you refer to adult-content Web sites.

The list provided is intended as a guide and should not be considered complete.

The goods available on BeaucoupPlus Web sites may be advertised by private individuals or merchants; the latter must display their merchant status and comply with existing tax regulations, in addition to the Consumer Protection Act, with regard to guarantees, remote sales, prohibited business practices or others.

Users must place their ads in the correct categories and sub-categories and BeaucoupPlus reserves the right to move them to another location, without notice, or to reject those that cannot be placed in any of the available categories.

BeaucoupPlus does not exercise total control over the ad content and advertisers are solely responsible for content submitted. Users are urged to use our notification system to report any illegal, offensive or false advertising or those that fail to respect trademarks, copyright or the user conditions governing this site.

BEAUCOUPPLUS RESERVES THE RIGHT TO REVISE OR DELETE ANY AD, COMMENT OR OTHER CONTENT ELEMENT NOT IN COMPLIANCE, WITHOUT REIMBURSEMENT OR PRIOR NOTICE.
